The district Judge in the Flynn case has refused to dismiss the case after being ordered to do so by the Circuit Court and is asking the Circuit Court to hear the case en banc (which means every Judge in the Circuit will have to rule). The Circuit could refuse to do this but it is likely they will give the Judge his hearing.

I don’t think the court will hear it further. The way these things work, no one will know until the court rules en banc and renders its decision or rejection. I am not sure if there is a time frame for the decision.
