    Mike Flynn Has One Hell Of A Case For Damages

    The DOJ moved to dismiss their lengthy prosecution of Michael Flynn and admitted they never had a good reason for bringing it in the first place. The trial judge tried to become the prosecution, but the appeals court said that was beyond his prerogatives to usurp the administrative branch’s powers and obligations to do so. In admitting the DOJ & FBI had no valid reason from the get-go to charge or even investigate Flynn, this has potentially opened the staff who carried out the misdeeds to personal civil suit...they only have limited immunity and there is copious evidence some went waaaay out of their way to hide their culpability and duty to give over Brady exculpatory evidence. As late as yesterday the DOJ is just now revealing more Peter Strzok emails, which have been described as bomb shell stuff.

    The late reveal of the Peter Strzok handwritten notes are bomb shells, as they have been released now. They put both Obama and Biden directing the attack on incoming DNI Mike Flynn —

    Handwritten notes taken by former FBI agent Peter Strzok revealed that President Barack Obama directed the FBI to continue investigating Lt. Gen. (Ret.) Michael Flynn just weeks before he was to become President Trump’s national security adviser, in a meeting during which Vice President Joe Biden suggested that Flynn violated the Logan Act.

    Up until now, it had been unclear exactly how involved Obama was in the FBI investigation of Trump’s national security adviser.

    Strzok’s notes are believed to have been taken on January 4, 2017, the apparent date of a White House Oval Office meeting with Obama, Biden, FBI Director James Comey, Deputy Attorney General Sally Yates, and National Security Adviser Susan Rice.

    The notes show, according to a court filing, that those officials discussed transcripts of Flynn’s private calls with Russian Ambassador Sergei Kislyak and how to proceed against Flynn.

    Obama himself directed that “the right people” investigate Flynn.

    The notes also show that Biden raised the prospect that Flynn committed a violation of the Logan Act — an obscure 1799 law that prohibited private citizens from conducting diplomacy on behalf of the U.S. and has never been successfully prosecuted in court...

    The Judge can still appeal for an en banc hearing. Don't be surprised.

    From today's WSJ:

    A federal judge can scrutinize the Justice Department’s unusual request to drop the criminal case against President Trump’s former national security adviser Michael Flynn, a U.S. appeals court ruled Monday, the latest turn in the continuing legal saga.

    The decision, on an 8-2 vote, was a setback for the department and Mr. Flynn, who had filed an emergency request asking the U.S. Court of Appeals for the District of Columbia Circuit to allow the dismissal of charges and to end the case immediately.

    I hope they hang the General from the highest tree in DC. A cunning criminal such as Flynn should deserve no less. The FBI is being wrongfully judged for doing a stellar job getting the conviction. The trial court conducting the proceeding handled the matter with the highest regard for an unbiased judiciary.
