    Playing pro football not a viable defense for DWI...

    A player for the Buffalo Bills (I'm pretty sure that's a pro team) found no fans in the law enforcement community of Montgomery County last night...Defensive tackle Ed Oliver Jr. was stopped, checked and arrested after his erratic driving was reported by another motorist...
    The driver of the vehicle did have an open beer between his legs and appeared nervous. A Montgomery County Precinct 4 DWI Certified Deputy responded to the scene and performed a field sobriety test.
    In my opinion the stupid looking tires that stick out far beyond the fenders should have been a separate offense, but that's just me......Ben

    at least he wasn't like the two other NFL morons that got arrested for armed robbery at a party and used their own exotic cars for the getaway. They stole cash and watches....they used to make over a million dollars a year. now they are finding themselves kicked out of the NFL..effing thugs

    Agreed...I read about that...The guy from last night seems to have accepted what was happening to him...Our DA has assistants on call to get warrants when a driver refuses a mandatory blood draw, but I didn't see any in the video, so it looks like this guy may have consented...A wise move if he plans to continue his career......Ben

    I haven’t been keeping up with current firearms laws in Texas lately, Ben, but doesn’t the guy have a good defense on the face of that charge?

    If it was in the glove box or console he should be OK as long as he had no restrictions on possession of a firearm...If he was asked about any firearms in the car, and failed to disclose, he'll have a problem...If it was on his person without a CHL/LTC he'll have another problem...I haven't really kept up with the changing laws, but that's my understanding......Ben

    The "traveler" exemption was so vague it was just about worthless. They have changed that to allow any person who can legally possess a firearm to have one in their vehicle. No permit required.

    In the case Ben cited, the suspect was deemed intoxicated which disqualified him from possessing any firearm until such time as he was no longer intoxicated.

    I remember it, but I think it became moot when the laws changed a couple of decades ago...If Wikipedia is a viable source:
    Vehicle carry is allowed without a license if the firearm is not in plain sight.

    I support the law, though it may entrap me. We do what we can do. Traveling from Utah to CA and NV is entertaining.

    I'm older now and feel the need for additional protection. I put many cons behind bars as an Agent of the state - as did my wife. I've usually got a firearm or a blade (I prefer the Samurai style) handy these days. But, due to a few motorcycle accidents, I'm now at a maximum Opiate level. I feel competent, but a court or jury may disagree.

    I'm at a max opiate level also, 200 mg but don't have your background. Although I can't even feel the opiates any more a court of law would have me locked up quickly for any kind of driving or self-defence issue. I'll be alive though, I don't travel around naked.

    Sorry, but my old criminal defense lawyer instincts (yeah, I was one of those too) sometimes pop out when I read these things even though I am way out of touch. That the certified DUI officer (never heard of that before) had doubts about what kind of impairment the guy was under also raises red flags. In any case, if the guy was swerving around the road, we can all be satisfied when he was pulled off it.

    I never heard of it either, Joe...The latest available Montgomery County jail bookings are for 5/16/2020, and do not list him...However, the story was filed in the wee hours of 5/17 so if he was booked it may not appear until tomorrow...I checked the current jail roster yesterday, and he was not listed which means he was either not booked, or bonded out right away...The photos show him in handcuffs which does not necessarily mean he went to jail...Nothing in the story or photos indicates he was uncooperative...

    A news search turned up a lot of articles on the incident...Here is one from Rochester N.Y...I'll look for story updates later......Ben
