    It seems Stolarczyk had been robbed previously, and apparently by the same miscreants...The Oneida County DA is saying he brought this misery on himself by being a hoarder...A strange accusation to make against a man who didn't even have enough money to keep his own electricity turned on...
    Now Oneida County District Attorney Scott McNamara is shifting the blame for the robberies to Stolarczyk, calling him a hoarder and implying that he was just asking to be robbed. McNamara said “a large amount of property” believed to have been taken from the initial burglary at Stolarczyk’s home was discovered at Nicholas Talerico’s apartment in Utica during the investigation of the shooting.
    Sharp-eyed readers will note that the DA confirms evidence of the previous burglary by the same bottom-feeders, but focuses his attention on the only living person he can still prosecute, the survivor...Just another good reason to live in Texas......Ben

    When I prosecuted all those years ago in Texas (praise be upon it ) of the several instances similar to this which occurred on my watch, we (LEO’s of all stripes) thanked the potential victim for a job well done and saving us the time. If the perp was left wounded and soaking up someone’s funds in the hospital, we advised more time at the range and in one instance, a heavier caliber.

    I recall one particularly heinous incident when one of my favorite detectives was called to the scene of rape/murder of an elderly woman, where he started looking around opening a closet and out-jumped the perp. I asked why we were prosecuting the creep, and he explained that he was not ready because he figured the closet had long-sense been searched.

    Many, many years ago, in a legendary, perhaps mythical state called "Texas ", I was told of a homeowner who had shot a burglar after the burglar had kicked in his back door while the homeowner was on the telephone with the local constabulary. The burglar had run back out the door with two .30-.30 rounnds having passed through his abdomen and collapsed in a field. He survived, and the local constabulary awarded the homeowner with an "Honorary Deputy" citation.

    Somewhere, I think I still have a copy of the emergency call complete with the sounds of a .30-.30 being fired. My voice sounds strange when listening to a recording.

    Before I built the gun store, I worked gun shows with a then-retired, now deceased (RIP Art) police chief who was an ammo manufacturer on the side...One Sunday he showed up late at the show, and said he was involved in a shooting the night before...A burglar woke up him and his wife trying to get through their bedroom window...By the time Art got up with his S&W 4006, the guy had broken through the back door, and was in the house...He fired two shots, one completely missing the perp, and the other hit him in the foot...The responding deputies arrested him out in the yard rolling around bleeding...

    After he detoxed from whatever drug he was on, and while he was awaiting trial, he filed a lawsuit against Art alleging an "attractive nuisance" because he just knew there were valuables inside their house, and couldn't help himself...I found a silhouette target and drew a bullseye on its left foot, and told Art I was going into business selling them...I offered him a commission if he'd autograph it...He offered a suggestion where I could put the target, and I think the lawsuit was eventually dropped after the judge stopped laughing......Ben

    I had a ner do well kick in my back door whilst I was at work. He encountered Shady my 24hr a day home defender. A 140 pound Malamute. When I got home she was happily chewing on a large piece of denim. The entire back left pocket plus 3-4 inches of surrounding material. Blood was all over my back hallway up the back deck stairs, across the deck and over the fence. The LEOs found the would be thief in emergency surgery at Watsonville hospital undergoing emergency butt cheek reattachment. It took over 300 stitches and staples to put him back together

    More facts coming to life and the local DA seems to be justifying his charges against the homeowner by alleging that the victim of the burglary was inviting the altercation because he was hoarding too much stuff in his ramshackled abode —

    ...Stolarczyk’s father either gave or left the handgun in question to his son. Under New York’s famously restrictive gun control laws, the son wasn’t required to undergo a background check to receive the handgun from his father. But he did need to have a pistol permit to legally own the firearm and have it registered in his name.

    Now Oneida County District Attorney Scott McNamara is shifting the blame for the robberies to Stolarczyk, calling him a hoarder and implying that he was just asking to be robbed. McNamara said “a large amount of property” believed to have been taken from the initial burglary at Stolarczyk’s home was discovered at Nicholas Talerico’s apartment in Utica during the investigation of the shooting.

    Items recovered included an old Commodore computer and an old bicycle, McNamara said.

    Stolarczyk knew he had been burglarized recently, said his lawyer, Mark Wolber.

    “He had a lot of stuff in his place, and we believe the Talericos knew that, and were under the mistaken impression that the home was vacant,” McNamara said.

    The home has no electricity and no running water, the DA said. The home has been condemned due to its condition, he said.
