    I have a question

    ....and while it might seem silly I am dead serious.

    First---as I understand it, under current law anyone who enters the US by any means cannot be deported without first being afforded a hearing which comes about only after a long wait. By the time of the hearing the "line crosser" may or may not show up.

    So---unless I am wrong on that I have the following conundrum:

    At the western terminus of the boarder the barrier runs a rather short way into the ocean. I have attached a picture below. Now--it would seem to me that anyone, swimmer or not, could easily wait until low tide, put on a life jacket and float along the barrier (and use the barrier) to go safely and quickly around the end and there you are in the land of milk and honey

    Obviously, a decent swimmer would need no aid, or with a touch of forethought any type of raft or boat could be utilized to transport the entire family in safety.

    So--what am I missing here?

    No, not everybody who steps foot on American soil is granted a visit to a judge before being deported. That is part of the messed up immigration laws that have been implemented over time and then ignored of they did not want to enforce them.

    If you are from some South American countries and set foot on American soil, yes you will get a hearing before your deported & some countries you could stay like Cuba till the law was changed. My younger brother just retired (medically) from DHS in Miami and has been shot by illegals trying to not be deported & then they had to go to court for shooting a DHS officer when before it was a one way ticket to the home country. He was on a multi jurisdictional task force related to drugs, human smuggling and cartels when he was medically retired.

    Your first premise is incomplete, Dave, as I have read numerous times any one except Mexican citizens can demand a hearing, if they declare refugee status and seek asylum for protection from certain actions in their home country. Mexican citizens are specifically exempted from that law and can be deported without a hearing. One more glitch in the law, which provides that as much as toe on American soil invokes the asylum exclusion from deportation, is that our fences and barriers all are on our side of the border with open strips of American soil on the foreign side such that “a toe is on American soil” even before the immigrant reach the fence or barrier! An example is the U.S./Mexican border at the Rio Grande is in the middle of the river and any fence is on land. The space between the fence and middle of the river is unrestrained American territory. Catch 22.

    The current law is moronic unless you are for open borders.

    Thank you Joe for answering the question. I was not aware of the distinction between country of origin.

    For all but Mexicans, if they figure it out this could bring a new meaning to the old slang term.
