GPS Tracking Info and Crime Scenes

It was only a matter of time before we started being tracked by our GPS enabled phones but even if we turn it off the information is still accessible.

I use Google maps and I can look back several years and see exactly where I was on a particular date and time.
I just go to Google.com/maps and click on my timeline on the drop-down menu and it will give the information of every trip I have made.

I wonder if that can be used as evidence in a court case by the prosecution or the defense?

Google was served at least four sweeping search warrants by Raleigh, North Carolina police last year, requesting anonymized location data on all users within areas surrounding crime scenes. In one case, Raleigh police requested information on all Google accounts within 17 acres of a murder, overlapping residences, and businesses. Google did not confirm or deny whether it handed over the requested data to police.

As long as they don't tell the FBI where I am I don't care who else they tell.

What I was wondering about is can the information derived from these cell location records be admitted as evidence in court or are they simply an investigatory tool to narrow down suspects?

I suspect that the state would necessarily have to verify the accuracy of the information before it is admitted. Good luck on getting a witness from Google in court to do that. I would also object that where my client’s phone was does not mean he/she was there.

I was thinking the same thing but it would give the investigators a place to start. Would the fact the phone was at a crime scene provide probable cause for a warrant?

I think it is difficult to stay away from Google and other collectors of information. Those (95 viewing) are bots collecting our posts for future use.

It is tracking all the time.

It will show me going up into the mountains until it loses signal and the extrapolate my route to where it again regains signal. It shows the extrapolated route as a dotted line.

Technology will continue to march on despite our Neo-Luddistic efforts to push it back into the bottle.

We have folks tracked down from DNA that was deposited at crime scenes years ago and facial recognition technology being used in crime detection as well as private sector sales efforts.

It is a Brave New World, not for the timid or the faint of heart.

Most of the time as long as your not breaking the law your OK but there are always those pesky unsolved cases that need to be wrapped up at some point, it helps to be white and rich, they don't even bother calling you then.
