Fred, There is nothing needed to invoke the law. The only requirement is for ANYONE to submit a claim that X Y Z has said things, indicated by thought or action , even jokingly , that they would like to hurt someone .
Next thing you know, the po po are knocking on your door at 5:00 AM demanding your guns. Resist in any way and you are likely to be shot .
Reference the news that a sister complained about her 61 Year old brother, the cops showed up and the result is a DEAD person who has never harmed a soul.

I’ve been a prosecutor and know first hand the innate power to abuse power. I never blindly trust those holding the power will not abuse it. To give authorities the power to first seize your property and then you have to fight to get it back is backwasswards.
he system sucks and it isn't about being good or bad it's about being known. I've been there and once the powers that be get a hold of you they don't let go. 43 years ago I committed a felony, I still can't work in a courthouse, I've got a degree in Psy. but they won't let me work in a school, I couldn't go to my son's graduation from boot camp last month. I could give you quite a few other troubles I've had but I'd have to put some of them in Triguys thread. Be careful there are not many states that your wife, cousins etc... can't have you committed for drinking too much, and no it doesn't matter if you do. You'll get a hearing within 45 days where you can say your peace.

I'm hoping these so called red flag laws make it to SCOTUS in record time. In my opinion the red flag law is an illegal taking by government. If a person is dangerous enough to warrant the government to take his private property without a hearing, that person is dangerous enough to be incarcerated if they have violated any laws, or dangerous enough for an involuntary commitment to a mental health facility if his sanity is questioned. With the person under control, a judge can determine if there is probable cause to seize his weapons.
